What If I am Not at Fault
If you’re in a wreck, the insurance company for the at-fault driver, pretending it’s not you, should make you an offer on your property damage. They have to pay you a fair market value for your vehicle, or they should pay to have it repaired. And it’s really important that whatever you decide is fair value for your vehicle is something that you can live with, because when you settle your property damage, you can’t come back and ask for any more money no matter what you later discover. The same thing is true with your personal injury claim, is if you’re offered X number of dollars to settle your injury claim, it doesn’t matter if the next day you discover you’ve got a new injury, or you need a surgery, or anything else goes wrong. You’re done. You’ve settled that claim. So talk to an attorney before you settle your property damage, or your personal injury claim to make sure that you’re getting fair value.
