The last thing a person needs after being injured in a preventable accident is to face the financial burden of resulting medical treatments on their own. While insurance companies may present a friendly appearance and make you think they are on your side, the truth is that insurance providers are businesses and will likely search for a reason to deny or limit your compensation.
Our Springfield, MO injury attorneys can negotiate with insurance companies on your behalf and fight to help you secure a fair settlement for your injuries.
We are equipped to handle insurance claims and lawsuits surrounding the following:
- Car accidents
- Drunk driving accidents
- Motorcycle crashes
- Medical malpractice
- Truck accidents
- Slip and fall injuries
- Work related injuries
- Nursing home abuse
If successful, you may be entitled to recover monetary damages for losses related to medical bills, rehabilitation costs, property damage, lost wages, lost earning potential, and pain and suffering.
If a loved one has unfortunately passed away in an accident caused by another party’s negligence, a wrongful death lawsuit can be filed in pursuit of compensation for funeral expenses, loss of personal relationship, and lost future income. It is imperative you consult with our firm as soon as possible to review your legal options and determine your specific range of compensation.
How Long Do I Have to File a Personal Injury Claim?
According to the Missouri Code section 516.120, Missouri has a five-year statute of limitations on a personal injury claim. This means that you have five years from the date of your injury to file a claim or you may lose your right to compensation. If your injury claim is against a government worker or entity the statute of limitations shortens to 90 days.
Missouri does recognize a few exceptions to this five-year rule, where the statute of limitations may be extended including if the injury victim was under the age of 21 at the time of injury. In this case, they would have five years after they turn 21 years old to file a claim. Similarly, if an individual is declared legally mental incapacitated at the time of injury they have five years from the date of their mental recovery to file. Last, if a defendant leaves the state after an accident but before a claim can be filed, the time they are absent from Missouri is usually not counted in the five-year time period.
If We Do Not Win, You Do Not Pay
Victims of personal injuries may benefit from consulting a skilled personal injury attorney who can advise victims of their opportunities for financial recovery and what important steps should be taken.
