How Long Do I Have to File a Personal Injury Claim?
According to the Missouri Code section 516.120, Missouri has a five-year statute of limitations on a personal injury claim. This means that you have five years from the date of your injury to file a claim or you may lose your right to compensation. If your injury claim is against a government worker or entity the statute of limitations shortens to 90 days.
Missouri does recognize a few exceptions to this five-year rule, where the statute of limitations may be extended including if the injury victim was under the age of 21 at the time of injury. In this case, they would have five years after they turn 21 years old to file a claim. Similarly, if an individual is declared legally mental incapacitated at the time of injury they have five years from the date of their mental recovery to file. Last, if a defendant leaves the state after an accident but before a claim can be filed, the time they are absent from Missouri is usually not counted in the five-year time period.
