What Damages Are Available in a Personal Injury Case?
There are three main types of damages available in a personal injury case, economic, non-economic, and punitive. Economic damages, as the name suggests, compensates for financial losses associated with suffering an injury such as the inability to work, medical bills and any future medical expenses. Non-economic damages cover the more intangible losses that result from an injury such as pain and suffering, emotional distress, and loss of enjoyment of life, among others.
Since non-economic damages cover losses that are abstract in nature, they are also called general damages. The last type of damages, punitive is unlike the first two in that their main purpose is to punish the negligent party as opposed to compensating an injury victim for a loss. Unlike some states, Arkansas has no limit, or cap, how much in damage an individual can be awarded.
